Terms of Service
Plain terms covering this website, our estimates, and the work itself. Your signed written contract always governs the specific job.
Effective September 9, 2026 · Piñon Painting & Fine Finishes · CSLB #976750
1. Agreement to these terms
These Terms of Service (“Terms”) govern your use of https://www.pinonpaintingag.com (the “Site”) operated by Piñon Painting & Fine Finishes (“we,” “us,” “our”), a California licensed contractor, CSLB #976750. By using the Site you agree to these Terms. If you do not agree, please do not use the Site.
2. The written contract controls the work
Nothing on this Site is a contract for services. Any painting, refinishing, washing or carpentry work is governed by a separate written home improvement contract signed by both parties, prepared in accordance with California Business and Professions Code requirements. Where anything on this Site conflicts with your signed contract, the signed contract controls.
3. Estimates and proposals
- Estimates are free within our service area and are provided after an in-person walkthrough. We do not issue binding prices sight-unseen.
- An estimate is an offer to perform a defined scope of work at a stated price. Unless otherwise noted in writing, estimates are valid for 30 days from the date issued.
- Estimates cover only what is itemized. Conditions that cannot reasonably be seen at the walkthrough, such as dry rot behind intact paint, failed substrate under existing coatings, hidden water damage, prior work that must be corrected, may require a written change order.
- You approve every change order in writing before that work proceeds. We do not perform additional billable work and present it to you afterward.
4. Scheduling, access and site conditions
- Start dates are estimates. Exterior work is weather-dependent, and we will not apply coatings outside manufacturer specifications for temperature, humidity, dew point or surface moisture. Delays for weather are not a breach of contract.
- You agree to provide reasonable access to the work areas, along with water and electrical service, during scheduled working hours.
- Please secure or remove valuables, fragile items, wall hangings and window coverings before work begins unless we have agreed in writing to handle them.
- Pets should be secured away from active work areas for their safety and ours.
5. Homes built before 1978
Federal law requires renovation firms disturbing painted surfaces in housing built before 1978 to follow lead-safe work practices. If your home falls in that category, we will discuss the required practices, containment and documentation with you before work begins, and the associated requirements will be reflected in your estimate and contract.
6. Colors, sheens and finish expectations
- Color and sheen selections are yours. We strongly recommend approving physical samples in your own space and lighting. Printed chips, screens and photographs are not reliable representations.
- Repainting after work has begun because of a change of mind is billable, priced as a change order.
- Some substrate conditions cannot be made perfect by paint. Prior texture, patching, settlement cracking, uneven drywall and existing surface defects may remain visible. We will point these out before work begins wherever we can see them.
- Decorative and hand-applied finishes are, by their nature, variable. Approved sample boards represent character and technique rather than an exact reproduction.
7. Workmanship
We stand behind our workmanship. The specific warranty terms, duration and exclusions applicable to your project are stated in your written contract. Warranties generally do not cover damage from causes outside our control, including but not limited to structural movement, water intrusion, roof or gutter failure, deferred maintenance, physical damage, abuse, or failure of substrates and materials we did not supply or install.
8. Payment
Payment terms, deposit limits and progress payment schedules are governed by your written contract and by California law. See our Refund & Cancellation Policy for details on deposits, cancellation rights and refunds.
9. Use of this Site
- You may not use the Site for any unlawful purpose or in a way that harms it.
- You may not scrape, harvest, republish or resell Site content without our written permission.
- You may not submit false information, impersonate another person, or use the estimate form to send unsolicited commercial messages.
10. Intellectual property
All content on this Site, including text, photographs of our completed work, layout, design and logo, is owned by Piñon Painting & Fine Finishes or used with permission, and is protected by copyright and trademark law. Project photographs depict work performed by our crew.
11. No professional advice
Content on this Site is general information about painting and finishing, not a professional assessment of your property. Every home is different, and only an in-person walkthrough can tell you what yours actually needs.
12. Disclaimers and limitation of liability
The Site is provided “as is” without warranties of any kind regarding availability, accuracy or completeness. To the fullest extent permitted by California law, our liability arising out of your use of the Site is limited to the amount you paid us, if any, for access to it. Nothing in these Terms limits our liability for the performance of contracted work, for fraud, for personal injury, or for any liability that cannot lawfully be limited. Liability relating to a specific project is governed by your written contract and applicable California law.
13. Contractor licensing and consumer protection
Contractors are required by law to be licensed and regulated by the Contractors State License Board, which has jurisdiction over complaints against licensed contractors. You may verify our license, and file a complaint if you ever need to, at cslb.ca.gov or by contacting the CSLB directly.
14. Dispute resolution
We would much rather fix a problem than argue about one. Please contact us first at (805) 234-0762 so we have the opportunity to make it right. Any dispute relating to the Site is governed by the laws of the State of California, without regard to conflict-of-law rules, and will be brought in the state or federal courts located in San Luis Obispo County, California. Dispute procedures for a specific project are governed by your written contract.
15. Changes to these Terms
We may update these Terms from time to time. The effective date at the top of this page reflects the current version, and continued use of the Site after changes are posted constitutes acceptance of them.
